			<content:encoded><![CDATA[<p style="text-align: justify;"><span class="bodytext"> Why does it take so long to get an answer from the Immigration Service? This is a question that many people ask when applying for visas or adjustment of status. In my practice I get a number of calls each week from clients wondering when they will get approval on an application for a work permit, adjustment of status, or a visa extension.</span></p>
<p style="text-align: justify;">It is taking longer than ever to get approvals from the USCIS (US Citizenship and Immigration Service). These delays continue despite the extreme increase in filing fees last July (2007). Most fees doubled and some tripled. Citizenship applications are now backlogged to about nine months.</p>
<p style="text-align: justify;">Pending applications for citizenship, green cards, and other types of visas are now at an all time high of about 6.8 million in the U.S., up more than 60 percent since the year 2006.</p>
<p style="text-align: justify;">There are a number of causes for these delays. Increased security checks for green card applicants, student visa applicants, and those attempting to get work permits, is a major reason for the delays.The &#8220;Real ID Act&#8221; passed by Congress in 2005 requires additional background checks for people applying for citizenship or lawful permanent residency. Immigrants from certain countries (Middle East and some Asian countries) are put through extra FBI checks, which takes considerable time. In addition, the USCIS often lacks enough funding to hire the needed personnel.</p>
<p style="text-align: justify;">With an increasing number of applications and more security checks you would think that the Government would be hiring more people to fill the gaps. Unfortunately, this is not happening. However, the USCIS has publicized that it is trying to bring back some retired USCIS workers on a temporary basis.</p>

<p style="text-align: justify;">Me and my fiance have an odd problem and are now with trying to find out if it is legally possible. He is an American citizen and he applied a petition for K1 Fiancee Visa two years ago. My fiancee has a child from his previous marriage and he had failed to pay the required amount of child support. He does have a better job now but pays 50% of what he earns to his ex for child support. During the initial checks for K1 Fiancee Visa there was a court trial that put my fiancee on probation and fined $90 000. He is now paying it off. He was told that he can rid himslef of this problem only by settling all the money at once, which would be very difficult.</p>
<p style="text-align: justify;">
<p style="text-align: justify;"><strong>K1 Fiancee Visa : Child Support</strong><br />
If the terms of his probation is that he has to have settled the amount before you can get a K1 fiancee visa, then it will affect your interview if he has not settled the amount outstanding. If however you do enter the United States and file for an adjustment of status, he would need to prove that he has sufficient income to support you and whoever of the child/children he is required to support. Best to see an lawyer about the situation in any event.</p>

<p style="text-align: justify;">2. G-325A form</p>
<p style="text-align: justify;">3. Birth Certificates</p>

me to join him in the United States so that we can get married. We know that the processing centre had received our paperwork (I29-F)  yet we still don&#8217;t have a receipt number. We called them and they have not told us anything. They said that we must have to have a receipt number to check the status of the <a title="K1 Fiancee Visa" href="http://www.thaiembassy.com/thailand/k1-visa.php">K1 Fiancee Visa</a>.</p>

<p style="text-align: justify;">Has the check for the filing fee ever been presented for payment? See if you have a<br />
record that the check had been presented. You might just be able to obtain a receipt number through that. If it has been more than a year, why are you only now wondering about what it? The receipt notice should normally have arrived within 1-2 weeks from the date of your filing for the K1 fiancee visa.</p>

<p style="text-align: justify;">Your father in Thailand needs to apply for a US Visitor Visa / US Tourist Visa and be prepared to present as much documentation as what he can about his close ties to Thailand and that he will not immigrate to the United States. There is a very likely chance that he will be denied a US Tourist Visa if he is not able to prove to the satisfaction of the consular officer that he will not immigrate. You and your US husband can only write a letter of invitation to him and provide an also provide an affidavit of support. Alternatively obtain the services of an immigration attorney in Thailand.</p>

<p style="text-align: justify;">He I am filing the initial paper work for a K1 fiancee visa, and I need to know a few things. I have been told that I would need pictures of myself and my Thai fiance together taken within the last two years. Do then need a certain amount of pictures to send or can I simply  send just a couple of pictures? Also do I need to send copies of some emails and/or instant messages. I met my Thai fiancee 3 years ago and we have been communicating with Yahoo messenger for a lot of the time, except for the first 3 months, which was done by email. We were not able to get any pictures until really recently due to the area were she lived in when we had first met. Is this a problem for the K1 fiancee visa?</p>

<p style="text-align: justify;">You will need to submit proof of having met<strong> in person</strong> within 2 years (that is why the pictures would be very helpful) and other evidence of a bona fide relationship.
